1. Agreement
By accessing or using 42marketing.ai (the “Site”) or engaging our services, you agree to these Terms of Service. If you do not agree, please do not use the Site or our services.
2. Our services
42Marketing provides marketing services, including AI visibility (GEO/AEO) and ChatGPT Ads management. The specific scope, deliverables, fees, and term of any engagement are governed by a separate written agreement or proposal between you and 42Marketing. If that agreement conflicts with these Terms, that agreement controls for the services it covers.
3. Use of the site
You agree to use the Site lawfully and not to:
- Use it for any unlawful or unauthorized purpose
- Interfere with or disrupt the Site or its infrastructure
- Attempt to gain unauthorized access to any part of the Site
- Use automated tools to scrape or extract data without our written permission
4. Engagements and payment
Fees, billing frequency, and payment terms are set out in your engagement agreement or proposal. Unless otherwise stated in that agreement, fees are non-refundable for periods already served. Failure to pay may result in suspension or termination of services.
5. Client responsibilities
Where we provide services, you agree to provide timely access, information, and approvals reasonably needed for us to perform. You are responsible for the accuracy of materials you provide and for ensuring you have the rights to any content, trademarks, or assets you ask us to use.
6. Third-party advertising platforms
Our services may involve third-party platforms such as ChatGPT Ads, Google Ads, and Meta Ads. Ad approval, delivery, placement, pricing, and performance on those platforms are controlled entirely by those platforms and are outside our control. We do not guarantee any specific ad approval, ranking, visibility, lead volume, or business result. You are responsible for complying with each platform’s own policies and terms.
7. No guarantee of results
AI visibility and advertising outcomes depend on many factors beyond our control, including the behavior of AI platforms, search and advertising algorithms, competitor activity, and your own market. We provide our services with professional care but do not warrant or guarantee specific rankings, visibility, AI recommendations, traffic, leads, or revenue.
8. Intellectual property
The Site and its content, design, and branding are owned by 42Marketing. Ownership of deliverables produced during an engagement is governed by your engagement agreement. You retain ownership of materials you provide to us.
9. Confidentiality
Each party agrees to protect the other’s non-public business information shared in connection with an engagement and to use it only for purposes of that engagement.
10. Disclaimers
The Site and services are provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the Site will be uninterrupted or error-free.
11. Limitation of liability
To the maximum extent permitted by law, 42Marketing will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability arising from the Site or our services will not exceed the amount you paid us in the three (3) months preceding the claim.
12. Indemnification
You agree to indemnify and hold 42Marketing harmless from claims arising out of your breach of these Terms, your misuse of the Site, or content and materials you provide to us.
13. Termination
We may suspend or terminate your access to the Site at any time for any reason. Termination of service engagements is governed by your engagement agreement.
14. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in Martin County, Florida.
15. Changes
We may update these Terms periodically. Changes will be posted here with a revised date. Continued use of the Site after changes take effect constitutes acceptance.
